RISE Pole Vault Facility Rental Agreement

This Facility Rental Agreement ("Agreement") is entered into by and between RISE Pole Vault ("Facility" or "RISE"), and the undersigned individual or organization ("Renter"). By signing this Agreement, Renter agrees to abide by the terms and conditions set forth below for the rental and use of the Facility.
Rental Terms & Conditions
1. Facility Use: The Renter is granted access to RISE Pole Vault for the agreed-upon rental period. Use of the Facility is strictly limited to pole vaulting and related activities.
2. Staff Presence: Renter acknowledges that RISE Pole Vault staff may or may not be present during the rental period. Renter assumes full responsibility for the safety and conduct of all participants.
3. Scheduling: Rentals must be scheduled in advance and are subject to availability. The Facility reserves the right to refuse or cancel a reservation at its discretion.
4. Fees & Payment: Rental fees must be paid in full prior to use. No refunds will be issued except in cases where RISE cancels the rental.
5. Cancellation Policy: Cancellations must be made at least 48 hours in advance for a full refund. Cancellations within 48 hours are non-refundable.
6. Insurance Requirement: Renter must provide a Certificate of Insurance (COI) listing RISE Pole Vault as an additional insured before using the Facility. The COI must cover general liability with a minimum coverage amount specified by RISE.
Safety & Equipment Usage
1. Pre-Use Inspection: Renters and all participants must inspect poles, pits, standards, and other equipment before use. Any defects or concerns must be reported to Facility staff immediately.
2. Pole Safety: No athlete is allowed to vault on a pole rated below their body weight. RISE staff reserves the right to check pole ratings and enforce this policy at all times.
3. Risk & Supervision: The Renter is responsible for ensuring that all participants use the Facility in a safe and responsible manner. Minors must be supervised at all times by a responsible adult.
4. Unsafe Behavior: If an athlete demonstrates behavior that endangers themselves or others, RISE reserves the right to require them to stop pole vaulting with no refund issued.
5. Personal Equipment: Renters are responsible for their own poles and other equipment. RISE is not liable for lost, stolen, or damaged personal equipment.
6. Damage Responsibility: If any equipment, including but not limited to pole vaulting poles, pole vaulting pits, standards, or other Facility equipment, is damaged during the rental period, the Renter is responsible for the cost of repair or replacement.
7. Participant Waivers: All participants must sign a liability waiver prior to engaging in any activities at the Facility. RISE reserves the right to deny participation to anyone who has not completed the waiver.
Indemnification & Hold Harmless Agreement
The Renter, on behalf of itself, its participants, guests, employees, agents, and affiliates, hereby agrees to defend, indemnify, and hold harmless RISE Pole Vault, its owners, officers, employees, agents, insurers, and affiliates (collectively, "RISE") from and against any and all claims, demands, lawsuits, damages, liabilities, costs, attorney's fees, medical expenses, or judgments (including but not limited to bodily injury, death, or property damage) arising out of or related to:
1. Any injury, accident, or loss occurring at the facility during the rental period, regardless of cause, including but not limited to negligence (whether active or passive) by RISE.
2. Any failure by Renter, its participants, or affiliates to comply with the terms of this Agreement.
3. Any property damage or injury resulting from equipment use, including but not limited to pole vault poles, pits, runways, and related equipment.
4. Any claims arising from COVID-19, infectious diseases, or other illnesses contracted while using the facility.
This indemnification expressly includes claims alleging negligence by RISE Pole Vault, but does not apply to gross negligence or intentional misconduct by RISE.
The Renter expressly waives any and all claims against RISE Pole Vault, whether known or unknown, related to the use of the facility. This waiver applies to all participants, coaches, employees, spectators, and guests of the Renter.
This section shall survive the termination of this Agreement.
General Rules & Conduct
1. Facility Rules: All participants must follow posted Facility rules and staff instructions at all times.
2. Clean-Up: Renter is responsible for cleaning up after use, including removing personal belongings and disposing of trash.
3. Damage: Renter is responsible for any damages caused to the Facility or equipment due to negligence or misuse. Costs of repairs or replacement will be charged to the Renter.
4. Alcohol & Drugs: The use of alcohol, drugs, or any intoxicating substances is strictly prohibited. Anyone suspected of being under the influence will be removed from the Facility without refund.
5. Right to Refuse Service: RISE reserves the right to deny entry or terminate the rental agreement without refund if Facility rules are violated or if behavior is deemed unsafe or inappropriate.
